L’Istituto del recesso e fruibile solo ed esclusivamente da parte del Cliente Consumatore; con il termine Cliente Consumatore si intende la persona fisica che acquista per scopi personali e quindi del tutto estranei ad attività imprenditoriali, commerciali o professionali eventualmente svolti.
Il Cliente Consumatore ha diritto a recedere dal Contratto di Acquisto per qualsiasi motivo e senza necessità di fornire spiegazioni, salvo il rispetto delle procedure di seguito indicate:
1: Il Cliente Consumatore dovrà comunicare la sua decisione di recedere dal contratto entro 14 giorni ricorrenti da quando ha ricevuto il prodotto (o nel caso di acquisto di più prodotti consegnati separatamente con un solo ordine, da quando ha ricevuto l’ultimo prodotto);
2: tale comunicazione dovrà essere fatta inviando una lettera Raccomandata A/R a: ANDYCARDS SRL Viale dei Navigatori 4A, 48122 Punta Marina Terme (RA);
3: la suddetta comunicazione scritta dovrà contenere tutti i dettagli necessari ad individuare in modo inequivocabile la transazione oggetto della recessione;
4: Il Cliente Consumatore potrà anche preavvisare la sua intenzione con l’invio di una mail all’indirizzo di posta elettronica store@andycards.it; si sottolinea che il preavviso mail ha il solo scopo di accelerare i tempi necessari alla conclusione di tutto l’iter e non preclude l’obbligo della comunicazione scritta di cui sopra;
5: nel rispetto delle istruzioni ricevute da Andycards, il Cliente Consumatore provvederà, a proprio esclusivo onere e responsabilità, alla spedizione e restituzione delle merci oggetto del recesso a ANDYCARDS SRL Viale dei Navigatori 4A, 48122 Punta Marina Terme (RA)
6: la rispedizione ad Andycards delle merci oggetto del recesso dovrà essere fatta antro 14 giorni ricorrenti decorrenti dalla data in cui il Cliente Consumatore ha provveduto ad inviare la Lettera A/R di cui al precedente punto 2;
7: la rispedizione ad Andycards delle merci oggetto del recesso resta a carico e responsabilità del Cliente Consumatore, pertanto Andycards non risponde in nessun modo per eventuali danneggiamenti o furti o smarrimenti che possano accadere durante la rispedizione e resteranno in capo al Cliente Consumatore;
8: una volta verificata l’integrità dei prodotti oggetti del reso, Andycards Srl provvederà a rimborsare al Cliente Consumatore le somme esborsate per l’acquisto al netto degli oneri di spedizione;
9: data la particolarità dei prodotti oggetto delle transazioni, l’ammontare del rimborso a seguito di reso verrà determinato in base ai seguenti criteri:
9.1 se trattasi di prodotti sigillati all’origine dal produttore o editore (come confezioni speciali, Box di buste, ecc.) il rimborso verrà fatto al 100% del valore di acquisto alla condizione essenziale che tali prodotti siano pervenuti ancora perfettamente sigillati ed integri; contrariamente Andycards rimborserà i prodotti con un importo pari al valore commerciale degli stessi nello stato in cui si trovano al momento di ricezione del reso;
9.2 se trattasi di carte singole, il rimborso verrà fatto al 100% del valore di acquisto alla condizione essenziale che le carte ritornino nello stato conservativo originale di acquisto; contrariamente il rimborso verrà decurtato percentualmente in base al grado di usura o di danneggiamento riscontrato; altresì potrà essere applicata una riduzione del valore di rimborso pari alla perdita del valore commerciale della carta riscontrata tra la data di acquisto e la data di ricezione del reso da parte di Andycards;
Una volta verificata l’integrità dei prodotti restituiti e/o valutato lo stato conservativo degli stessi, Andycards provvederà a rimborsare al Cliente Consumatore l’importo dovuto calcolato applicando i criteri di cui ai precedenti punti 9.1 e 9.2 (al netto delle spese di spedizione originariamente sostenute) entro e non oltre 30 giorni dalla data di rientro dei prodotti medesimi. Il rimborso nei termini anzidetti verrà scortato da regolare documentazione fiscale, e verrà eseguito in accordo con il Cliente Consumatore con il metodo concordato per iscritto fra le parti.
